James Cameron, Disney Sued Over Unauthorised Use of Actress’ Likeness in Avatar
James Cameron and Disney have been sued by actress Q’orianka Kilcher over the unauthorized use of her likeness in the production of Avatar (2009). Kilcher alleges that Cameron and his design team based the character Neytiri—portrayed by Zoe Saldaña in the film—on her physical appearance without her knowledge or consent.
According to the lawsuit filing, the claim stems from Kilcher’s role as Pocahontas in Terrence Malick’s 2005 film The New World, which she appeared in at age 14. Kilcher asserts that Cameron explicitly instructed his design team to use a photograph of her from The New World’s set as the basis for Neytiri’s visual design. Despite this alleged use of her likeness, Kilcher states she never provided permission for this appropriation.
The lawsuit raises significant questions about digital likeness rights and the obligations of filmmakers to obtain consent when using real individuals’ appearances as reference material for character design.
